Automatic Draft Registration: Section 535 of the 2026 Defense Bill
Evidence rating: CONFIRMED. Congress passed, and President Trump signed on December 18, 2025, a law that makes the government register every draft-age man automatically, starting December 18, 2026. It is Section 535 of Public Law 119-60, the National Defense Authorization Act (NDAA) for Fiscal Year 2026.
Until now, a young man had to sign himself up for Selective Service, and by 2024 nearly one in five eligible men had not. From December 2026 the job belongs to the government: the Selective Service must find every man aged 18 to 26 in federal records and put him on the list, whether he acts or not. The agency's own description: "This statutory change transfers responsibility for registration from individual men to SSS through integration with federal data sources" (Military Times, April 8, 2026). Its critics call it involuntary. Its sponsor calls it a way to spend money on "readiness" and "mobilization" instead of advertising. Both are describing the same sentence of law.
The law, in one sentence
"Except as otherwise provided in this title, every male citizen of the United States, and every other male person residing in the United States, between the ages of eighteen and twenty-six, shall be automatically registered under this Act by the Director of the Selective Service System."
(Public Law 119-60, Section 535). The same section lets the agency demand from any "Federal entity" a man's birth date, address, Social Security number, phone, and email; deletes the old legal defense for men whose failure to register was "not knowing and willful"; replaces the Secretary of Health and Human Services with "Federal agencies" as the data source; and ends the need for a presidential proclamation to trigger registration. It takes effect "one year after the date of the enactment." Every clause is walked through on Section 535, Line by Line.
Where it came from
The idea originated inside the Selective Service under President Biden. Rep. Chrissy Houlahan (D-Pa.) offered it in the House Armed Services Committee in May 2024: "By using available federal databases, the [Selective Service] agency will be able to register all of the individuals required and thus help ensure that any future military draft is fair and equitable" (Defense News). The committee approved it unanimously. See Houlahan's Amendment.
The House passed it in June 2024, 217 to 199, the weekend the story went viral; the Senate committee's version would have registered "every citizen," women included. Both were stripped in closed-door negotiations in December 2024. See The 2024 Round.
How it passed, and when
The House put it back in its FY2026 bill on September 10, 2025. The Senate's version left it out. The closed House-Senate negotiation put it in. The House agreed 312 to 112 on December 10, 2025; the Senate 77 to 20 on December 17; the President signed December 18. No member cast a separate vote on it, and no hearing was held. Edward Hasbrouck: "enacted without hearing, debate, or any budget review" (Responsible Statecraft, March 10, 2026).
The dates matter. The law was signed six months after the June 2025 U.S. strikes on Iran's nuclear sites and ten weeks before the February 28, 2026 war began. It takes effect in the middle of that war. The public learned of it eleven days into the war, from the Ron Paul Institute headline "As Iran War Escalates, Congress Passes Automatic Involuntary Draft Registration" (Ron Paul Institute, March 11, 2026), which reached millions. See How It Passed.
Implementation: the rule, the data, the simulation
The Selective Service sent its implementing rule to the White House on March 30, 2026, one month into the war, and withdrew it without explanation on July 23, 2026. The statutory deadline did not move. On July 22, 2026 the agency asked vendors for a "Readiness Simulation" of a national mobilization. Which databases will feed the list, Social Security, DMV, Census, IRS, DHS, is still unsettled; see Implementation and the Data Behind the List.
What it means for a family
A list is not a draft. But a complete, current list is the thing a draft cannot work without, and until now the government did not have one; a former director called the old database "less than useless" for a real draft. Hasbrouck, the week it passed: it "doesn't mean that a draft is being activated right away ... although preparing to do so is the sole purpose of making this list. This will, however, be the largest change in Selective Service law since 1980, and will move the U.S. closer to activation of a draft than at any time in the last half century" (Responsible Statecraft, December 16, 2025). The Friends Committee on National Legislation, a Quaker lobby: "The federal government will now automatically register young men for the draft, without their consent" (FCNL, May 14, 2026).

What a citizen can check
- Read Section 535 in the public law PDF; search for "SEC. 535."
- Watch reginfo.gov and the Federal Register for the new rule. When it is published for comment, anyone may comment.
- Ask your representative how they voted on the FY2026 NDAA on December 10, 2025, and whether they knew Section 535 was in it.
Status: Chrissy Houlahan, Donald Trump, Daniel McAdams, and Edward Hasbrouck are alive.
