What Congress Has Added Since the Iraq War: The Machinery of Compulsion, 2006 Versus 2026
Evidence rating: CONFIRMED for the statutory changes (Section 535 of Public Law 119-60) and the Army's age limits. STRONG for the 2026 mobilization steps, reported by several outlets and summaries. MODERATE for Iraq-era recall figures from explainers.
About twenty years ago, in 2006, the United States was fighting a long ground war in Iraq with no draft. The power to induct was the same then as now: one act of Congress away. What has changed is everything around that power. This page sets the two years side by side, because "the draft is the same as it has always been" is the most common reassurance parents hear, and it is no longer true.
What was the same in 2006
- Induction. Barred after July 1, 1973 by 50 U.S.C. 3815(c), restorable by Congress. An AI summary in 2026 put the continuity plainly: "Registration itself has been required since 1980," and "A draft still requires a separate act of Congress plus presidential approval (last one ended 1973)" (Grok on X, September 22, 2026).
- The call-up and stop-loss powers. 10 U.S.C. 12302, 12304, and 12305 were in force; stop-loss was used on a large scale. "Stop loss and forced recalls… literally less than 20 years ago… involuntary service," one poster wrote in 2024 (post). An explainer counts "Nearly 18,000 Army and Marine IRR members recalled between 2003–2006" (majaporter on Threads).
- The Army's age ceiling of 42. It was raised to 42 in 2006 during the Iraq war and lowered back to 35 in 2016 (The World Correspondent on X).
- A vote on the war. Congress voted on the Iraq authorization on October 10, 2002. "Members had to put their names on the line before anyone's kid put boots on the ground" (Mike Young on X, February 28, 2026).
What is different in 2026
| 2006 | 2026 | |
|---|---|---|
| Who registers | The young man, himself; the FAFSA form supplied about a quarter of registrations | The government, automatically, from federal records, from December 18, 2026 (Section 535) |
| Data the draft agency can demand | From HHS only | From "Federal agencies," any data "the Director determines necessary" |
| Defense for men who never registered | "Not a knowing and willful failure" | Deleted from the statute |
| Registration trigger | Presidential proclamation | Standing duty of the agency; no proclamation needed |
| War authorization | Congress voted on Iraq in October 2002 | No authorization; a majority of both houses directed withdrawal in June 2026, and the war continued (June 2026) |
| The Individual Ready Reserve | Recalled for Iraq | Reportedly redesignated a primary "mobilization asset," March 2026 |
| National mobilization planning | No exercise since 1978 | Congress directed a "21st-century mass mobilization exercise," the first since 1978 (as reported); National Defense Strategy calls for "nothing short of a national mobilization" (as reported) |
| Draft agency rehearsals | Routine | "Special skills" exercise (January 2026); national-mobilization "Readiness Simulation" requested (July 2026) |
| Draft selection | Lottery by birthday | Lottery still in law; think-tank war games propose "replacing the national draft lottery with artificial intelligence" |
| Defense budget | Not compared in our sources | About $901 billion enacted for FY2026; about $1.5 trillion requested for FY2027 |

In their words
- "The largest change in Selective Service law since 1980, and will move the U.S. closer to activation of a draft than at any time in the last half century" (Edward Hasbrouck, Responsible Statecraft, December 16, 2025).
- "Tucked inside the FY2026 National Defense Authorization Act ... is the MOST SIGNIFICANT transformation of the Selective Service System (SSS) in over four decades ... one that moves the United States closer to being able to activate a 'draft on demand' than at any point in the past half century" (AJ Signal on X, May 15, 2026).
- "You used to have to fill out paperwork, then it went to the convenience of a website, now it will just be automatic" (Organ O'Zukerkandl on X).
- "Only for #Vietnam, 2 World Wars, & the Civil War has America at 250 req'd & ensured all young (men) register to go to war" (kitzelpie on X, August 1, 2026).
"No draft after twenty years in Afghanistan"
Some answered that nothing essential has changed. "No draft after 20 years in Afghanistan but 4 weeks with Iran and we are suddenly running out of troops?" one man wrote to Mary Trump in April 2026 (post). He is right that the power to induct was unused for twenty years of Afghanistan. The difference is that during those twenty years no one rebuilt the list, rewrote the data powers, raised the enlistment age during a blockade, and asked contractors to simulate a national draft. Mary Trump's own line, which he was answering: "Draft-dodging presidents should not have the power to impose the draft" (Mary Trump on X, April 10, 2026).
Status: Edward Hasbrouck, Mary Trump, and the posters quoted are alive.
