Penalties for Refusing: Prison, Fines, Lost Jobs, and What a Reactivated Draft Would Bring
Evidence rating: CONFIRMED for the statute and the Selective Service's stated penalties. CONFIRMED that criminal prosecution for non-registration stopped in the 1980s. STRONG that enforcement would harden in a real draft, which every source on the subject expects.
The penalty is the part of the draft law most parents get wrong in both directions. Some believe nothing happens to a young man who refuses. Others believe his whole family goes to prison. The truth is precise, and it is written down.
Two crimes, one section
50 U.S.C. 3811(a) covers anyone who "evades or refuses registration or service in the armed forces." That is two different acts:
- Failing to register. A crime today, for men 18 through 25.
- Refusing induction. A crime only if Congress restores the draft and an induction order is issued. As an AI summary put it in April 2026: "if a draft is activated and you're ordered to report for induction but refuse to show, it's a federal felony. Penalty: up to 5 years in prison and/or a $250,000 fine. (No active draft exists now—only registration is required for eligible men.)" (Grok on X, April 9, 2026).
A lawyer's explainer puts both together: "A man who knowingly fails or neglects to register with the Selective Service, or who refuses to report for induction, can be prosecuted and, if convicted, can face a fine of up to $250,000 and/or a prison term of up to five years" (Foretellr on X, October 24, 2023).
The numbers
The statute says "imprisonment for not more than five years or a fine of not more than $10,000, or by both." The Selective Service states the fine as "up to $250,000," which comes from the general federal fines law for felonies (SSS benefits and penalties). Both figures circulate: older posts and one AI reply use $10,000, news reports in 2026 use $250,000. Posts claiming "20 years in federal prison" for not registering (post, October 9, 2024) are wrong; that number comes from World War I cases against political dissenters.
The statute of limitations runs five years past the 26th birthday (50 U.S.C. 3811(d)).
What actually happens today: the benefits cut
Prosecutions for non-registration stopped in the 1980s; see Prosecution History. The government enforces instead by taking things away. The New York Post, as reposted, listed it: non-registrants "could also be denied student loans, government jobs (including federal, state and local) and US citizenship, if they are immigrants" (Victor Nava's report). Federal student aid was cut loose from registration in 2021, but federal jobs (for men born after December 31, 1959), federal job training, citizenship for immigrant men, and many state jobs and aid still depend on it (SSS 101 guide).
A mother described what it meant at home: "When my son graduated and turned 18 he had to register or be put in jail because it's a felony not to register. The draft is entirely different that uses selective service to call young men to war" (post, March 14, 2026). Another said she would have welcomed automatic registration for her son because missing it is "a federal felony" (Trish S on X, April 10, 2026).
What automatic registration changes
Supporters say the automatic system protects young men from the felony. "It is already a felony to not register with selective service (since 1980) The automatic part prevents young men from intentionally committing a crime" (Michael Breen on X, April 9, 2026). The sponsor said it "finally ensures that young men are not unknowingly penalized" (CNN). The same law deletes the "not knowing and willful" defense (50 U.S.C. 3811(g)) and replaces the man's act with the government's. The trap of forgetting closes; so does the quiet exit of declining. See Section 535, Line by Line.
If a draft is restored
Three things change.
- The induction felony comes alive. Refusing an order to report becomes the crime, with the same five-year maximum.
- The obligation does not expire. Under 50 U.S.C. 3803, a man who "has failed or refused to report for induction shall continue to remain liable for induction and when available shall be immediately inducted."
- Enforcement follows need. "Prosecutions are rare today but would likely increase in a real draft" (Grok on X, March 4, 2026). "The leniency currently shown on these issues would probably go away" (Quora). In World War II, around 16,000 men were prosecuted, by one summary's count.
The alternatives written into the law are narrow: conscientious-objector status for opposition to "war in any form," and a few classifications and postponements. See Conscientious Objectors and The Lottery and the Order of Call.
Parents and helpers
The duty belongs to the young man; a parent cannot register for him or refuse for him. But the same section makes it a crime to "knowingly counsel, aid, or abet another to refuse or evade registration or service." See The Counsel-and-Aid Clause.
Fake penalties
In January 2020, fake texts warned of "a minimum of six years in jail if recipients don't report for immediate departure to Iran." A TV station told viewers not to fall for it (FOX6 Milwaukee). If your family receives anything that claims to be an induction order, check it against the law: there is none until Congress acts, and a real one would need provable delivery, which a former prosecuted resister says means "certified letter or personal service, not by email or phone."
