Section 535, Line by Line: What the Automatic Draft Registration Law Says
Evidence rating: CONFIRMED. Every quotation on this page is from the enacted statute, Section 535 of the National Defense Authorization Act for Fiscal Year 2026, Public Law 119-60, or from the House-Senate compromise text that became it, Rules Committee Print 119-16, dated December 7, 2025.
Most people who heard about "automatic draft registration" heard it from a headline. Few read the section itself. It is short, and every sentence matters to a family with a son. This page walks through it in order.
The heading and where it sits
The compromise print labels it plainly: "SEC. 535. SELECTIVE SERVICE SYSTEM: AUTOMATIC REGISTRATION." It is one section in a defense bill that the Senate carried as S. 1071 and that ran to more than a thousand pages. Edward Hasbrouck, who has tracked draft registration for decades, places the text at pages 361 to 365 of the conference report; the enacted words sit at 139 Stat. 871 to 872 of the public law. Section 535 rewrites the registration section of the Military Selective Service Act, codified at 50 U.S.C. 3802. It does not touch the separate section that bars induction after 1973; that barrier is explained in The Power to Induct.
Sentence one: who is registered, and by whom
"Except as otherwise provided in this title, every male citizen of the United States, and every other male person residing in the United States, between the ages of eighteen and twenty-six, shall be automatically registered under this Act by the Director of the Selective Service System."
Three things changed in that sentence.
- The actor. Before, the law told the young man to present himself for registration. Now the law tells the Director of the Selective Service System to register him. The man does nothing, and it happens anyway.
- The word "shall." It is a command to the agency, not an option.
- The pool. "Every other male person residing in the United States" reaches green-card holders, refugees, asylum seekers, and undocumented men, as CNN summarized on April 9, 2026. Women are not in the text.
"Between the ages of eighteen and twenty-six" means from the 18th birthday up to the 26th. That is why some reports say "18 to 25" and others say "18 to 26": they describe the same window.
The one exception
The print keeps a single carve-out: the requirement "shall not apply to any alien lawfully admitted to the United States as a nonimmigrant under section 101(a)(15) of the Immigration and Nationality Act ... for so long as such alien continues to maintain a lawful nonimmigrant status." A man here on a student or work visa is outside it. No other exception appears in the section. Deferments and exemptions from service exist, but they come later, only after a draft is activated; see The Lottery and the Order of Call.
The data the government may collect
The section lets the Director write regulations requiring a person to provide "date of birth, address, social security account number, phone number, and email address." It then goes further. The regulations may require:
"a Federal entity to provide, to the Director, information described in paragraph (1) that the Director determines necessary to identify or register a person subject to registration under this section"
That is the engine of the change. "A Federal entity" is not limited to one agency. The judgment of what is "necessary" belongs to the Director. Hasbrouck summarized it in his December 16, 2025 article: "The automatic registration provision grants the SSS unprecedented authority to require any other Federal agency to provide the SSS with any information 'that the Director [of the SSS] determines necessary to identify or register a person subject to registration.' But it imposes no such obligation on state governments." Jackie Singh, in an essay titled "DOGE Has the Draft List" on March 9, 2026, described the job as an order to "identify, locate, and register" every man in the age band by aggregating Social Security, IRS, and immigration records and "whatever else the SSS Director 'determines necessary.'" Which databases the agency will actually use is covered in Implementation and the Data Behind the List.
The notice
The Director must send each registered man "written notification" that he "has been so registered" and, "if such person is not required to be so registered, the procedure by which such person may correct such registration." The notice tells him he is on the list. It does not ask his permission.
The effective date
"The amendments made by this section shall take effect one year after the date of the enactment of this Act."
The President signed the bill on December 18, 2025. The new system takes effect on or about December 18, 2026. Some summaries give December 19; the difference is how "one year after" is counted.
The quiet edits most coverage missed
Section 535 also rewrites other parts of the draft law so they fit the new system. Each one tightens the net.
- The "not knowing and willful" defense is deleted. Old 50 U.S.C. 3811(g) said a man could not be denied a federal right or benefit for failing to register if he showed "the failure of the person to register was not a knowing and willful failure to register." Section 535(b)(4)(C) strikes that subsection. When the government does the registering, the old shield for men who never signed up is gone.
- "The Secretary of Health and Human Services" becomes "Federal agencies." The old 3811(e) let the President require only HHS to hand over names, birth dates, Social Security numbers, and addresses. The new text reaches every federal agency.
- Registration no longer waits on a proclamation. The print strikes the words "upon publication by the President of a proclamation or other public notice fixing a time for any registration under section 3." Registration used to be switched on by the President. Now it is a standing job of the agency, running permanently.
- The refusal language is struck. Wording about "neglecting, or refusing to perform the duty of registering" is removed. There is nothing left for a man to refuse: the act is no longer his.
That last change is why critics call it involuntary. Hasbrouck argues that ending self-registration closed the one route by which millions of young men quietly declined to join the list, and that the automatic list has a single purpose. "This doesn't mean that a draft is being activated right away, or that those registered will be sent induction orders — although preparing to do so is the sole purpose of making this list," he wrote in Responsible Statecraft. "This will, however, be the largest change in Selective Service law since 1980, and will move the U.S. closer to activation of a draft than at any time in the last half century."
What the section does not say
It does not mention Iran. It does not restore induction. It does not raise penalties. Those limits are real, and they are exactly why the section matters: it builds the part of a draft that takes years, the complete list, and leaves the part that takes one vote for later. A commentator summed up the arithmetic in April 2026: "No one is being drafted. The mechanism for drafting them has just become significantly more efficient" (Mike Young on X, April 11, 2026).
