Massie's Eight Articles of Impeachment Against Defense Secretary Hegseth (September 2026)
Evidence rating: MODERATE. We did not read the filing itself. This page reports its contents as summarized by several accounts that did. Every charge below is an allegation in an impeachment resolution, not a finding; the accounts that summarize it say so.
In September 2026, Rep. Thomas Massie filed eight articles of impeachment against Defense Secretary Pete Hegseth. The central charge is simple: Congress never authorized the Iran war, both chambers later voted to order the forces out, and the war went on. For a parent asking whether the "Congress must vote" safeguard still works, this filing is the record of a member saying it did not.
What the articles say, as summarized
The most complete summary came from a critics' account on September 17, 2026 (Libertarians Against Trump on X):
- Articles I to III, the war itself. "The Iran war itself was illegal, three separate ways. No declaration of war, no statute, no attack on the US, no imminent threat, starting Feb 28, 2026. Congress literally voted (House June 3, Senate June 23) to order troops OUT. Hegseth kept fighting anyway. Then blew through the War Powers Resolution's 60-day clock, then the 30-day withdrawal window, and kept the war running for 7 months total."
- Article IV, civilian protection and the Minab school. "Hegseth personally gutted the rules that protect civilians, then a school got hit. He tried to repeal the law requiring minimized civilian harm, cut casualty-tracking staff by ~90%, pulled military lawyers out of the process, and publicly mocked 'rules of engagement' as weakness. Then on Feb 28, three Tomahawk missiles hit an elementary school in Minab, Iran. 156-170+ dead. Over 120 of them children."
- Article V, boat strikes. "Turned suspected drug smugglers into military targets ... 67 boats, 221+ people killed, starting Sept 2025."
- Article VI, Sen. Mark Kelly. After Kelly said troops can refuse illegal orders, "Hegseth's DoD responded with a formal censure letter threatening to strip his military rank and pension. A federal court had to block it."
- Article VII, Venezuela. "Helped run an unauthorized operation to kidnap a foreign head of state ... 83 people killed in the process, including civilians. No congressional authorization, ever."
- Article VIII, Yemen. "Same illegal-war pattern in Yemen. 1,100+ strikes, 224 civilian deaths, no declaration, no authorization, and a required legal report filed late."
The account adds: "It's a 34-page filing read into the Congressional Record by a sitting Republican member of Congress, seven weeks before the midterms. And the Speaker of the House's move, instead of letting his own conference vote on it, was to cancel session and run out the clock." That last claim is the account's; one other poster made the same claim (LinRae Coon-Ras on X, September 19, 2026).
A second summary, posted September 20, names the legal hooks: War Powers Resolution sections 2(c) and 5(c), H.Con.Res. 86, the reported February 28 strike on the Shajareh Tayyebeh Elementary School, Sen. Mark Kelly, and operations named Absolute Resolve and Rough Rider (GoergeMasonJ6 on X).
The numbers that do not match
The count of the dead at the Minab school differs by source. The summary above says "156-170+ dead. Over 120 of them children." A March 2026 bulletin cited Human Rights Watch for "at least 160" including schoolchildren, and quoted Hegseth that the strike was "under investigation" (FrameTheGlobeNews on X, March 9, 2026). The Center on Conscience and War cited "over 110 children." A constituent wrote that "Pentagon reporting later said the targeting data was outdated" (Shannon on X). The footage is examined on The Minab School Video.
Why it matters
Impeachment will not pass a House whose leadership supports the war. The filing matters because it puts the June votes on the record as orders that were ignored. A parent reading it learns that the President and the Defense Secretary continued a war after both houses directed withdrawal, and that the Speaker chose not to let members vote on the consequences. That is the same Congress that holds the draft law. See June 2026: Both Chambers Say Withdraw.
Status: Thomas Massie, Pete Hegseth, Mark Kelly, and Mike Johnson are alive. The impeachment articles are allegations; no court or Senate has ruled on them.
