← The Draft Law Still in Force
Draft Registration from 1863 to 2026: How the List Kept Coming Back
Evidence rating: CONFIRMED for the statutes and dates that come from the U.S. Code, the Federal Register, and the Selective Service. MODERATE for historical enforcement numbers that come from secondary summaries; those are marked where they appear.
Americans are often told the draft is a relic. The list is not. Every generation since 1917 has been counted, the counting was paused only once, and each time it came back it came back stronger. Here is the record in order.
The Civil War: the first federal draft
The Union's Enrollment Act of 1863 was the first federal draft. According to one historical summary circulated in 2025, wealthier men could pay "a commutation fee of $300" to avoid service, evaders "could face arrest and jail time," and "Some evaders were apprehended and compelled to serve anyway" (summary on X, March 3, 2025). The pattern of the rich buying their way out began here.
1917: the Selective Service Act
Woodrow Wilson signed the Selective Service Act of 1917. The same summary says it first covered men 21 to 30, later 18 to 45, and that failing to register or report could bring prison; "Over 3,000 men were convicted," and some political dissenters received terms "up to 20 years in federal prison." Treat those numbers as the summary's.
1940: the first peacetime draft
On September 16, 1940, President Franklin Roosevelt issued Proclamation 2425 ordering registration under the Selective Training and Service Act of 1940. It was, in the words of a 2026 news summary, "the first peacetime conscription in American history" (California Post excerpt, as reposted March 27, 2026). The summary circulated in 2025 says penalties rose to "up to five years in prison and a $10,000 fine," and that "Around 16,000 men were prosecuted."
1948: the modern law
President Harry Truman signed the modern registration act on June 24, 1948; today's Military Selective Service Act descends from it (as summarized by Grok on X, April 9, 2026). It is now codified at 50 U.S.C. 3801 and following.
Vietnam: the draft that ended
The Vietnam draft took about 2.2 million men, roughly a quarter of the force, according to a March 2026 explainer (WW3 Tools). The 2025 summary says "209,000 were accused of draft offenses" and "fewer than 10% faced trial," that "Over 3,000 men were convicted," and that many fled to Canada or Europe; President Carter offered conditional amnesty in 1977. The last induction was June 30, 1973. Congress let induction authority lapse, and 50 U.S.C. 3815(c) now bars induction after July 1, 1973. President Ford suspended registration in 1975. The last lottery drawing was March 12, 1975.
1980: registration returns
After the Soviet invasion of Afghanistan, President Carter restored registration in 1980. Every man born on or after January 1, 1960 has had to register since (Art Candee on X; Military Times). One man who registered that first summer wrote years later: "On July 21, 1980 I registered for the Selective Service (draft) according to law set up by then President Jimmy Carter, who I did not like. But I was, and still am, willing to fight for this country" (comment on FOX6 Milwaukee post, January 2020).
1982 to 2021: tying registration to everything
Because prosecutions were rare, Congress enforced registration by attaching it to other things. The 1982 Solomon Amendment tied federal student aid to registration. States began registering men automatically when they applied for a driver's license: the agency's 2023 guide counts 41 states, and CNN, citing the 2024 annual report, counts 46 states and territories, with over 60 percent of registrations coming from motor vehicle departments in 2023 (CNN, April 9, 2026). A Threads commenter noted that in many states boys are signed up when they first get a learner's permit, so "the 'we will find you' piece of this it only for those kids who don't drive" (Threads, March 7, 2026).
The FAFSA link ended with the FAFSA Simplification Act, implemented in 2021 (Federal Register, June 17, 2021). The student-aid form had supplied "nearly a quarter of all previous registrations," and compliance fell to 81 percent by 2024. That fall is what drove the automatic system.
January 2020: the Soleimani scare
After the U.S. killed Iranian General Qassem Soleimani, the Selective Service website crashed. The agency tweeted, "Due to the spread of misinformation, our website is experiencing high traffic," and said "Congress and the President would need to pass official legislation to authorize a draft" (Time, via Yahoo, January 4, 2020). That scare, and how it differs from 2026, is on The 2020 Soleimani Draft Scare.
2024 to 2026: automatic
In 2024 the House passed automatic registration and the final bill dropped it. In December 2025 it passed. From December 18, 2026, the government registers every man automatically from federal records (The 2024 Round; Section 535). A retired Marine medic summed up the arc in April 2026: "You used to have to fill out paperwork, then it went to the convenience of a website, now it will just be automatic. It's a felony to not register punishable by a $250,000 fine or 5 years in prison" (Organ O'Zukerkandl on X, April 22, 2026).
The pattern
Each step made the list more complete and less dependent on the young man's own act: first he was summoned by proclamation, then he registered himself, then he was registered when he asked for a license or student aid, and now he will be registered from federal records whether he asks for anything or not.
